These Terms of Service govern your access to and use of the ZYNKIN platform. By creating an account or using our services, you agree to these terms. Please read them carefully.

1. About these terms

These Terms of Service ("Terms") form a binding agreement between you and ZYNKIN Technologies Ltd ("ZYNKIN", "we", "us", or "our"), a company being established in Ireland. They apply to your use of our website, platform, browser extension, and related services (together, the "Service").

If you are using the Service on behalf of a company or organisation, you confirm you have authority to bind that entity to these Terms.

2. The Service

ZYNKIN is a network intelligence platform that helps you discover relevant conversations on social platforms, generate comments and content in your personalised voice using artificial intelligence, and manage professional engagement. Engagement actions are carried out through a browser extension that operates on your behalf, based on your instructions and approvals.

3. Eligibility and accounts

• You must be at least 18 years old to use the Service.
• You must provide accurate information when creating your account and keep it up to date.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• You must notify us promptly of any unauthorised use of your account.

4. Use of social platforms and automation

• You authorise the actions. ZYNKIN performs engagement actions, such as posting comments, on your behalf and at your direction, through a browser extension acting from your own account. You are responsible for reviewing and approving content before it is published.
• You are responsible for platform compliance. Each social platform has its own terms of service and rules, which may restrict automated or assisted activity. You are solely responsible for ensuring your use of ZYNKIN complies with the terms of any platform you connect. You use the Service in connection with those platforms at your own risk.
• No affiliation. ZYNKIN is an independent product. We are not affiliated with, endorsed by, sponsored by, or otherwise associated with LinkedIn, X, Instagram, or their parent companies. All platform names and trademarks belong to their respective owners.
• Account consequences. Social platforms may, at their discretion, restrict, suspend, or terminate accounts. ZYNKIN is not responsible for any action a platform takes against your account, including restriction or suspension, arising from your use of the Service.
• Responsible use. You agree to use the Service responsibly and not to engage in spam, harassment, deceptive behaviour, or any activity that is unlawful or violates the rights of others.

5. Artificial intelligence content

• ZYNKIN uses artificial intelligence to generate suggested comments and content based on the voice profile and inputs you provide.
• AI-generated content may not always be accurate, appropriate, or suitable. You are responsible for reviewing all content before approving it for publication.
• You retain responsibility for everything published through your account, whether AI-assisted or not.

6. Your content

You retain ownership of the content and data you provide ("Your Content"). You grant ZYNKIN a limited licence to use, process, and store Your Content solely to provide and improve the Service. You are responsible for ensuring you have the rights to any content you provide and that it does not infringe the rights of others.

7. Subscriptions, billing, and refunds

• The Service is offered on a subscription basis. Plan features and prices are described at the point of purchase.
• Subscriptions renew automatically at the end of each billing period unless cancelled beforehand.
• You can cancel at any time; cancellation takes effect at the end of your current billing period, and you retain access until then.
• Except where required by law, fees already paid are generally non-refundable. Any add-ons or usage-based charges are billed as described at purchase.
• We may change our prices with reasonable advance notice. Changes apply to subsequent billing periods.
• Payments are processed by a third-party payment provider. We do not store your full payment card details.

8. Acceptable use

You agree not to:

• Use the Service for any unlawful, fraudulent, or harmful purpose.
• Send spam or engage in deceptive, abusive, or harassing behaviour.
• Attempt to reverse engineer, copy, or interfere with the Service or its security.
• Resell, sublicense, or provide the Service to third parties without our written permission.
• Use the Service in a way that violates the rights of others or any applicable law.

9. Intellectual property

The Service, including its software, design, branding, and content (excluding Your Content), is owned by ZYNKIN Technologies Ltd and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. You may not use our trademarks without prior written permission.

10. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we make no warranties of any kind regarding the Service, including its availability, accuracy, or fitness for a particular purpose. We do not guarantee any specific results, including engagement levels, leads, or business outcomes.

11. Limitation of liability

To the fullest extent permitted by law, ZYNKIN Technologies Ltd will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or business arising from your use of the Service. This includes any action taken by a third-party social platform against your account. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim arose. Nothing in these Terms limits liability that cannot be limited under applicable law.

12. Indemnity

You agree to indemnify and hold harmless ZYNKIN Technologies Ltd from any claims, losses, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights or platform terms.

13. Suspension and termination

We may suspend or terminate your access to the Service if you breach these Terms or use the Service in a way that may cause harm or legal risk. You may stop using the Service and close your account at any time. Provisions that by their nature should survive termination will continue to apply.

14. Changes to these terms

We may update these Terms from time to time. We will post the updated version with a revised "Last updated" date, and where changes are significant, we will provide additional notice. Continued use of the Service after changes take effect constitutes acceptance.

15. Governing law

These Terms are governed by the laws of Ireland. Any disputes will be subject to the jurisdiction of the courts of Ireland, without prejudice to any mandatory consumer protection rights you may have in your country of residence.
